Worker performing maintenance crushed by trailer

Unsafe working environments and occupational hazards continue to play a significant role in incidents of workplace injuries, and some of these incidents have led to serious injury or even death. One accident that took place on Feb. 4, 2015, in Texas, for example, demonstrates the critical need for safety measures to be implemented and properly maintained for reliable functioning.

A mechanic was performing maintenance on a commercial vehicle at around 11:40 a.m. when the safety mechanisms to keep it immobile failed. The man was crushed by the trailer and died the same day. The worker was reportedly attempting to fix the trailer’s brakes. It was stated that the reasons for the mechanical failures were still unclear at the time of the report.

Employees have the right to be safe while working. Similarly, employers are obligated to recognize potentially hazardous conditions that warrant preventative safety measures in the interest of protecting employees from harm. The failure to keep a safe working environment increases the chance of workplace accidents that lead to serious injury or death.

An injured employee may need to file a workers’ compensation claim in order to receive benefits during the period of time that the injury interferes with returning to work. Occasionally, insurance companies fail to act promptly on a claim and a victim may wish to obtain legal assistance in negotiating and seeking compensation.

If a workplace accident causes an injury, the victim can discuss the case with a lawyer. A lawyer experienced in personal law can be instrumental in handling the insurance company by recognizing stall tactics and fighting for the victim’s rightful compensation.
