The Department of Labor new overtimes rules have been blocked by a Texas Federal District Judge.
A Texas federal judge on Tuesday entered a nationwide injunction blocking the U.S. Department of Labor from implementing a controversial rule that would have expanded overtime protections, saying the rule improperly created a de facto salary test for determining which workers fall under the Fair Labor Standards Act’s so-called “white collar” exemption.
This means that the rules that were to go into effect December 1, 2016 will be blocked from being enforced. This case will be immediately appealed to the 5th Cir. Court of Appeals and will wind its way up to the U.S. Supreme Court. However with a new President almost certain to appoint a business friendly employer hostile U.S. Supreme Court Judge I suspect there is a good chance this law will never go into effect.
